Dr. Peter Mbae, the former head of Government Delivery Services, has formally submitted a petition to the International Criminal Court (ICC) seeking urgent intervention following comments made by Interior Cabinet Secretary Kipchumba Murkomen regarding the 2027 presidential election outcome.
The complaint stems from Murkomen’s public declaration on April 14, where he asserted with certainty that President William Ruto would win the 2027 presidential race regardless of circumstances.
In his petition, Mbae calls on the ICC Prosecutor to act swiftly to open an investigation into the situation in Kenya, expressing concern that such statements risk igniting violence similar to what the country experienced after the 2007 election.
“We have forwarded a copy of this letter to the ICC Prosecutor requesting immediate and urgent action to investigate the Kenyan situation, aiming to prevent a recurrence of the 2007 post-election violence,” the petition states.
Mbae underscored that the remarks by Murkomen appeared to legitimize predetermined election results, raising fears of state-sponsored actions that could undermine the electoral process.
On April 16, Mbae also wrote to the Ministry of Interior condemning the Cabinet Secretary’s statement, which was widely circulated in the media. He demanded assurances from Murkomen that the government would guarantee a free, fair, and transparent election in 2027.
Further, Mbae urged the government to publicly confirm its commitment to ensuring a peaceful election period without violence, intimidation, or suppression of voters.
“The implication of the statement is that the current administration may use all means necessary to influence the election outcome as declared by the Cabinet Secretary,” Mbae wrote in his letter.
The former Government Delivery Services chief argues that a prompt investigation by the ICC will serve as a deterrent against potential crimes against humanity linked to the electoral process.
